: 为解决我国农村留守儿童问题, 我国部分地 的中小学校和教师对留守儿童实行 代管! 在这种
代管中, 学校与被代管的学生之间应该是教育管理保护关系( 寄宿制学校除外) , 代管教师与被代管的学
生之间应该是一种委托监护关系在发生与被代管学生有关的损害赔偿纠纷时, 学校和代管教师在有过
错的情况下, 应该承担相应的赔偿责任我国应尽快完善法律法规, 建立和实施代管制, 从根本上解决对

Abstract: In order to solve the prblem of t he leftbehind children, some middle and element ary schools and
teachers have implemented the subst itute management to it. In the system, the relat ionship between the
schools and the students should be the educat ion, the management, t he protection ( except boarding school
) , the relationship betw een the teacher and the student should be one kind of request guardianship relations.
When damage compensation disput e betw een them occurrs, the school and the teacher w ho have fault,
should undertake the corresponding compensation responsibility . Our country should consummate the law s
and regulations as soon as possible, provides the legal safeguard for fundamentally solveing the substitute -
management implementat ion and the the social rescues for the left- behind children in the countryside.
