立法者的立法意图相距较远。且在其他方面表现出一定的缺陷，比如证据收集有困难等。最后，英国夫妻分割养老金制度对我国的启示。本部分针对前述我国现行立法不足与司法实践中存在的问题，借鉴外国立法与司法经验，结合我国实际情况，提出英国夫妻分割养老金制度对我国的启示。首先，改善立法的启示主要涉及：我国夫妻分割养老金价值的估算；夫妻分割养老金的方法。其次，改进司法的启示主要包括：适用的程序、法院判决和执行三个部分。养老金分割诉讼，可以适用普通程序；当符合法院衡量适用或者当事人合意适用的条件时，可以直接适用简易程序。且当事人享有程序选择权。在解决养老金分割的司法判决中，法院应考量分割的具体比例，要考虑“当事人的具体情况”以及“其他情况”。在养老金分割后的执行过程中，为了确保养老金利益的最终实现，养老金计划管理者须履行一定的责任，保障养老金的现金收益。关键词：英国夫妻分割养老金规则评析启示ABSTRACTInChina,undertheApril1,2004implementationoftheSupremePeoplesCourtontheapplicationoftheMarriageLawofthePRC,anumberofissuesofjudicialinterpretation(2),establishedthecouplesenjoyequalrightstoaccumulatedpensionsduringmarriage.InApril1,2004，Ourlegislatureexecuted“interpretation(2)oftheSupremePeoplesCourtonimplementing《MarriageLawofthePeoplesRepublicofChina》”，ofwhichthe11th3rdsectionhasestablishedthesharingrightofaccumulatedpensionsduringmarriage.However,ifonespousehadnotyetreachedtheageofreceivingpensions,thespousesduringthedivorce,willnotbeabletoreceivetheactualpensions.Thatistosaythepensions,whichhadnotyetactuallybeenaccessedbetweenmaritalperiods,areonlyexpectanteconomicalinterests.Thejudicialpracticeofsharingdifficultliesinthevalueappraisalandthemeansofpensionsharing,whichisadifficultproblem.Currently,onthedivisionoftheexpectantinterestsbetweenmaritalperiods,scholarsstudyinvolvingGermany,theUnitedStates,Australia,butdomesticscholarshadrarelystudiedthepensionsdivisionaboutBritishcouples.Andinthewesterncountries,theUnitedKingdomisnotonlytheearlierestablishmentofamodernsocialsecuritysystems,butalsothemodernrelativelysoundsocialsecuritysystemsinthewesterncountries.IntheUnitedKingdom,amongthemodernsocialsecuritysystems,thepensionsystemisbuiltfirst,butalsothedevelopmentofonewiththemoreperfect.ThelegislationofBritishcouplestosharepensions,themeansofestimatingthepensionsvalueandofdividingpensions,whichsetouttheentityrulesinverydetailed,specificandoperational,itisChinaslegislativereference.Therefore,Ionceco-authoredapaper,involvingtheentityrulesofpensionssharing,focusingontheassessment
