PAGE 学校代码： 学 号： 内蒙古自治区高等教育自学考试本科毕业论文 内蒙古自治区高等教育 自学考试本科毕业论文 题 题 目：未成年人刑事司法制度构建研究 学生姓名： 学科专业：法 律 指导教师： 主考院校： 二零一二年 二零一二年 月 摘 要 未成年犯罪是指已满14周岁不满18周岁的未成年人实施的刑法和有关刑事法律规定的犯罪行为。未成年人是祖国的希望与未来，所以对这一群体的犯罪行为应该引起高度的重视。由于未成年人在生理以及心理等方面与成年人存在着很大的差距，而这些种种因素将对未成年人犯罪的动机、目的、方法以及后果，因此，对于未成年人犯罪的司法处理也不能参照成年人的模式。虽然我国现有的刑事司法制度虽然也有一些特殊的规定，但是这些规定不够系统，缺乏实际上的可操作性，而且缺乏符合未成年人特点的一些制度。因此，在现有的未成年人刑事司法制度的基础上进一步构建就显得尤为重要的了。本文主要对我国未成年人犯罪的现状及特点以及未成年犯罪成因、我国未成年人刑事司法的现状进行了一系列的分析，并且提出了对我国未成年人刑事司法制度进一步构建提出了相关性的建议。 关键词：未成年人，刑事司法制度，构建 Abstract: the underage crime refers to the full 14 years of minors under the age of 18 the implementation of the criminal law and the relevant criminal law crime.
