McDonagh 123 S.W.3d 146 案例事實及程序(1) State Board of Registration for the Healing Arts (The Board)認為Dr. McDonagh使用螯合劑治療方法(chelation therapy)治療病人血管方面疾病的醫療行為違反section 334.100 ，對於Dr. McDonagh提出懲戒的行政處分。 案例事實及程序(2) The Administrative Hearing Commission (AHC)於1997年11月舉行聽證會，雙方各提出專家證人支持其論點: The Board方: 使用螯合劑治療方法治療病人血管疾病在血管治療的領域中不被一般性接受，因此該治療不符合該疾病治療血管方面疾病的醫療照護標準(standard of care)。 Dr. McDonagh方: 支持以屬於off-label use的螯合劑治療方法來治療。 AHC就該案之決議，認為Dr. McDonagh方所提出的專家證言可以被採認，且無證據證明螯合劑治療方法可產生任何傷害，因此裁定該懲戒的行政處分無理由。 案例事實及程序(3) 由於上訴巡迴法院支持AHC的看法，The Board認為AHC未能引用Frye案中對於專家證言的採認標準，將Dr. McDonagh所提出的專家證言之證據力排除，因此提出上訴。 Chelation therapy Chelation therapy is the administration of chelating agents to remove heavy metals from the body.
