摘班 摘要 伴随着参与式民主的兴起，公共参与已经成为现代民主制度的重要组 成部分。尽管中国自古都有天下公议的传统，但在具体的国家治理实践居 面，这一传统下的民众议政，在很大程度上仅仅具有呼吁和建议的效力，因而 没有成为国家治理的重要且不可或缺的组成部分。 而当时代发展到今天，随着社会主义市场经济的发展，社会利益日益多元 化，加之全球化浪潮的冲击，无论是普通公众，还是执政党领导人，都已经日 益感受到公共参与的竟要性。特别是在关系大多数人利益的土地利用活律制度 中，这…趋势表现地尤为明显。 为了更加清楚地描述和分析当代中国的土地利用法律制度椎架，本文首先 在梳理了公共参与治理模式的兴起背景之后，建立了一个由法律明确度和 法律拘束力组成的二维分析模型:其次，将中国土地利用法律制度大致分 为土地规划领域的法律制度和土地征收征用与补偿领域的法律制度，并在结合 具体的案例的基础之上分别考察这两个领域的法律文本规定，进而分析现行制 度所取得的成就和及存在的不足;再次，分别选取北美、西欧和东亚的法治发 达国家和蛐区作为案例，介绍这些国家和地区在土地利用公共参与过程中所建 立的特色制度和先进经验;最眉，在结合国情的基础之上，从公众参与的事项 范围、公共参与的机制设计和完善、参与渠道和沟通平台的多元化和协调化， 以及增强公共参与的法律效力，建立公共参与政策反馈机制等多个方面提出了 具体的建议和意见。 关键询:土地管理:土地利用:公共参与:法律效力 Abstract Abstract 币le pU叩ose of this study is to 伽d the development direction of the public participation in the land-use of China. We should know what we have achieved during 白e Thirty Years of Reform and Openíng-up，and what area is stil1 need to ke叩 working hard and ke叩 improving. Methods of documentation ，analysis of legal text，and case analysis，were employed by 伽 analytical framework which consists of the clarity of law and the binding force ofthe public opinion. 白le results indicate that achievements have been made in this 町ea by constantly testing，but still with certain flaws.
