. .. 甘肃政法学院 本科学年论文（设计） 题 目 论刑事特情的指挥和使用 公安分院(系) 侦查学 专业 2011级 1 班 学 号 201136020140 姓 名 宋杰 指导教师 杨宝宏 成 绩 完成时间 2013 年 11 月 论刑事特情的指挥和使用 宋杰 【摘 要】：刑事特情制度作为现代国家对抗犯罪的有效侦查措施，在打击犯罪方面起到重要作用，在刑事侦查活动中，通过刑事特情可以使侦查活动处于主动地位，节约侦查成本，刑事特情为侦查活动提供有利的情报与证据。但是刑事特情中的许多问题，如刑事特情能否犯罪、刑事特情的管理和指挥、刑事特情的刑事豁免以及如何使用等一系列问题一直都是理论、实践和立法所关注的焦点。关于刑事特情的讨论，立法界与司法实践活动中缺乏系统的理论，本文将对这一问题进行探讨，以规范刑事特情制度为出发点，而对我国司法实践活动提供指引，使得对刑事特情的使用法律化，提高刑事侦查工作的科学性，保障侦查效益。 【关键词】：刑事特情 管理指挥 刑事责任 价值 The signature handwriting Song Jie [Abstract] The effective measures of investigation of criminal intelligence system for modern country to fight crime, plays an important role in the fight against crime, in criminal investigation, the criminal intelligence can make investigation activities in the initiative, save the investigation cost, provide information and evidence favorable criminal informant investigation action. But criminal informant in many problems, such as the criminal immunity from criminal informant whether crime, criminal informant management and command, criminal informant and how to use a series of problems has always been the focus of theory, practice and legislation. Discussion about the criminal informant, lack of systematic theoretical legislation and judicial practice, this paper will discuss this issue, to regulate criminal informant system as the starting point, and provides guidance on the activity of the judicial practice of our country, makes use of the law on criminal informant, improve the science of criminal investigation, security the detection efficiency. [Key words] Criminal informant ；Management command ；Criminal responsibility 一、我国刑事特情制度的概况 （一）刑事特情概念刑事特情，又称线人、耳目或者秘密力量，是指在侦查活动中，侦查主体选择具有能接触犯罪组织或犯罪人员并且原意为侦查工作服务的特殊人员。刑事特情的使用是一种为了发现犯罪线索、收集犯罪证据、追究犯罪嫌疑人的侦查措施。 刑事特情制度的形成，其依据就是公安部于1984年8月制定并下发的《刑事特情工作细则》。按照公安部教育局编写的《刑事侦查学教程》，“特情是我国公安机关、国家安全机关内部对
