第三部分从介绍我国家庭暴力防治中的人身安全保护令的立法及司法实践入手，介 第三部分从介绍我国家庭暴力防治中的人身安全保护令的立法及司法实践入手，介 绍了有关人身安全保护令制度的沿革。对比了《反家庭暴力法》实施前后，人身安全保 护令签发情况的变化，肯定了《反家庭暴力法》取得的成就，但是通过分析案例，也发 现了现存的法律规定中存在的不足，例如家庭暴力的界定过于片面、代为申请人范围过 于狭窄、人身安全保护令内容不够全面、缺乏应有的未成年人特殊保护措施、并且在如 何执行人身安全保护令的规定上也有所欠缺。 第四部分是关于我国家庭暴力防治中的人身安全保护令制度的完善。针对笔者在第 三部分提出的部分欠缺提出了了相关的完善建议，如扩大代为申请人范围，制定有利于 受害人的证据规则、补充人身安全保护令的内容、合理规定人身安全保护令的类型和有 效期、细化人身安全保护令的变更与撤销条件等等。 目前我国虽然已经有针对家庭暴力防治的专门立法，关于人身安全保护令的相关规 定也开始实施，但是纵观《反家庭暴力法》全文，笔者认为人身安全保护令的相关制度 还存在部分问题。 关键词：家庭暴力人身安全保护令行为保全申请条件人身安全保护令的执行 IV 万方数据 Abs仃actAs Abs仃act As one of the hot issues，domestic violence iS also in serious condition in China．In recent years，the incidence of the domestic violence raises year by year．In china，there is no anti·domestic violence law．Although there are some regulations which aim to prevent the domestic violence，they do not work well．In 2008，the Supreme People’S Court of the People’S Republic of China once released The Manual for Trailing the Cases Involving the Domestic Violence to set examples to the judges．In this manual，there are some regulations about the，such as the application for the order,the confirmation of the order．But the manual should neither be quoted in the 1udgments，nor in the rulings．The PRC Civil Procedure Law revised in 20 1 2 stipulated behavior protection system．What is the protect orders to the behavior protection system is that a branch to the tree．But the regulations in the Civil Procedure Law of the 20 1 2 edition did not give any concrete explanations on the application of the the protect orders．To improve the legal system，the PRC Protection against Family Violence La w was drafted in 20 1 1 and released in 20 1 5 on the Internet．What a pity is that we still found some loopholes in this draft． This paper aims to provide some advice about how to fulfill the system of the protect orders，SO there are some flaws in legislation and practice of the protect orders listed，some opinions on the protect orders which are from the domestic expels and the fo
