PAGE \* MERGEFORMAT PAGE \* MERGEFORMAT 1 毕业论文 商业贿赂法律防控现状分析 摘　　要 商业贿赂是一种典型的不正当竞争行为。商业贿赂行为在世界各国普遍存在，也是许多国家的竞争法所禁止的不正当竞争行为。近年来，随着我国市场竞争的日益激烈，商业贿赂行为也日渐严重，已经成为一项“潜规则”，对社会和经济造成了极大的危害。与国外相比，我国反不正当竞争法立法起步较晚，对商业贿赂的专题研究也不深入，要有效防治商业贿赂，难度更大，任务更艰巨。鉴于商业贿赂的危害性和治理商业贿赂的严峻形势，本文从商业贿赂行为的基本问题入手，明确了商业贿赂的概念、构成要件、危害，并将商业贿赂和其他相关概念进行辨析，然后从法理学角度阐述，法律才是防控商业贿赂的重要手段。最后，在对我国商业贿赂法律防控制度体系的现状和法律防控的障碍进行分析的基础上，通过对相关国家商业贿赂的法律规定和先进经验的比较总结，结合我国社会的实际情况，对构建适合我国国情的商业贿赂防控体系提出了一些意见和思考。 关键词：商业贿赂　　相关概念 现状分析　　法律防控 Abstract Commercial bribery is a typical unfair competitive behavior. A global phenomenon,commercial briery is regarded as a misconduct and thus prohibited by competitive acts in many countries. In our country, commercial bribery cases shooting up sharply as a result of fierce market competition , has become a “unspoken rules” and greatly caused social and economic harm. Compared with abroad, the legislation of China’s Anti-Competition Law is later, and the monographic study to commercial bribery is not in depth. So it is difficult to effectively combat commercial bribery. In view of the harmfulness of commercial bribery and governance grim situation, this text from beginning the basic problem of the behavior commercial bribery, explicit the concept ,constitutive requirements, hazards, and analysis the relation of commercial bribery and other related concepts. Then, from the perspective of jurisprudence, the law is important means of preventing and controlling commercial bribery. Finally, the author summarizes legal provisions and the experience of many countries. Based on the analysis of the legal status and obstacles of prevention and control system, combining with the actual situation of our society, the author puts forward some views and thinking on construction of China’s national conditions for prevention and control system of commercial bribery.
