摘 要 传统孝道传承千年发展至今，在历史上起到了不可估量的凝聚力稳定社会的政治作用。 现代社会的法治背景下，传统孝道完善的理论体系没有吸收当代精神，与现代法律存 在很多冲突。本文通过对传统孝道历史发展过程中对社会治理作用的分析，明确传统 孝道的时代价值。传统社会和现代社会的时代背景的不同，赋予了孝道不同时期的内 涵。分别站在古今角度上，分析孝道内涵的价值，明确传统孝道内涵中与时代冲突的 部分。在分析传统孝道和现代法治的冲突后，提出措施尝试解决两者间冲突。重新建 构法治背景下的孝道观念，保存孝道中朴素的孝敬的内涵，剔除其作为政治手段的忠 孝的联系，使孝道和现代法律精神相容，消解传统孝道和现代法治的冲突。融合孝道 的德化作用构建和谐社会秩序，同时结合法治精神，推动法治深入人心，取得长足的 发展。 关键词：孝道；现代法治；冲突；化解；“于欢案” Abstract Traditional filial piety has inherited the Millennium Development and has played an invaluable cohesive force in history. Under the rule of law in modern society, the theoretical system of traditional filial piety has not absorbed the spirit of the present age, and there are many conflicts with modern law. Based on the analysis of the role of social governance in the development of traditional filial piety, this paper makes clear the value of traditional filial piety. The different backgrounds of traditional society and modern society endow filial piety with different periods. From the perspective of ancient and modern, we analyze the value of filial piety and clarify the conflict with the times in the connotation of traditional filial piety. After analyzing the conflict between traditional filial piety and modern rule of law, measures are put forward to resolve conflicts between them.Reconstructing the concept of filial piety under the background of the rule of law, preserving the connotation ofthe simple filial piety in the filial piety, eliminating the connection of loyalty and filial piety as a political means, making the filial piety and the modern legal spirit compatible, dispelling the conflict between the traditional filial piety and the modern rule of law. Combining the moral role of filial piety and building a harmonious social order, and combining the spirit of rule of law, therule of law is deeply rooted in the hearts of the people and has made considerable progress.
