PAGE PAGE 21 论夫妻离婚时对一方父母出资房的认定与处理 ——兼评《婚姻法解释三》第七条 摘要：《婚姻法司法解释（三）》第七条第一款关于婚后一方父母赠与不动产产权归属的规定，改变了离婚诉讼中出资方父母无明确意思表示时产权的配置方式，开启了一场横贯理论界、实务界的大讨论。在离婚率高企、房价飙升、财产分割“同案不同判”的当下，对该条款，可从婚姻的伦理性、夫妻财产制的选择、身份财产的处理、司法解释的目的性与工具性等视角去思考其涉及的社会、法律问题，并通过确立判断标准，考察其是否具有坚实的法理基础，是否充分评估法律风险，是否广泛凝聚社会共识。在此基础上，笔者从确立夫妻财产分割一般规则、完善立法体系、构建离婚扶养制度等角度提出立法建议，以期让婚姻法回归其身份法的本质属性，营造健康和谐的社会风气。 关键词：婚姻法解释三第七条第一款；房产；赠与；婚姻伦理；夫妻财产制 On the identification and treatment of contribution room sponsored by parents when couple divorced ——Comment on Marriage law interpretation three Article 7 Abstract: First paragraph of Article 7 in Marriage law interpretation three stipulates real estate ownership rules of gifts from parents after married, changing the distribution rule“parents have no clear declaration of will, affirm the ownership” in divorce litigation parents so as to arise a hot debate among the theorists and practitioners. Nowadays, with high divorce rate, soaring house prices, the treatment of this article can be figured from ethics of the marriage, choice of matrimonial property system, purpose of judicial interpretation and relative social and legal problems should also be considered, through establishment of criteria, judging whether the foundation of legal logic is firm or not, whether legal risks are comprehensively considered or not, whether correlate with social consensus. On these bases, author gives legal suggestions from judicial interpretations, improvement of legislative system and financial support system build, to help marriage law return to the essence of its identity law and create a healthy and harmonious social atmosphere.
