    TheTexasSupremeCourtrulingfinishesoffalengthyprocessthatbeganinMarch2020,whenCOG

    initiallysuedCactus,arguingthatitownstheproducedwater.Thestatedistricttrialcourtruledinfavorof

    COG.declaringthatCOGownstheproducedwaterandhasexclusiverightstoitspossession,custody,

    controlanddisposition.

    Thecourtofappealsaffirmedthisdecision,holdingthatproducedwaterisoil-and-gaswastethatbelongs

    totheminerallessee,notgroundwaterthatbelongstothesurfaceestate.Theappealspanelnotedthat

    theleasesdidnotsuggestanintenttoreserverightstooil-and-gaswasteforthesurfaceowner.Thecase

    thenprogressedtotheTexasSupremeCourt,whichheardoralargumentsonMarch18andrenderedits
