民国时期文官制度的转型 摘 要 文官制度，指关于文职官员的选拔、任用、培训、奖惩等一系列环节的规 章、制度。它是政治制度的核心组成部分。民国时期的文官制度建设是中国文 官制度现代化转型的首次尝试。研究这一过程，不仅有助于我们更好地理解民 国文官制度的历史地位和价值，对我国当前公务员制度的建设也大有裨益。 鉴于研究现状的不足，本文在韦伯官僚制理论框架下，采用纵向比较研究 方法，对民国时期中国文官制度的转型过程进行综合的分析，力求为更加完整 深入地理解民国文官制度并总结其得失经验提供新的视角。 文章第一部分理清了两个核心概念，一是传统文官制度的基本特征：士大 夫—胥吏政治；二是现代文官制度。 文章第二部分从理论渊源和现实需求两方面考察了转型的背景。理论渊源 包括西方经典行政学理论及同时代我国政治和知识精英对其的借鉴；现实需求 方面包括政治参与制度化的需要、对人才的需求以及提高行政效能的需要。 文章第三部分采用纵向比较方法，从三个方面分析了转型的表现：文官遴 选机制、结构类型以及文官的素质。每个方面都涵盖了制度的静态规定、实际 运作以及影响因素。 文章第四部分考察了制度绩效，引用民国时期政治和知识精英的论证，从 民主法治精神的缺乏、技术责任主义的缺失、政令不统一三个方面分析了制度 转型为何没有带来理论上的高效率。 文章第五部分反思了文官考试与教育的关系定位以及官僚制本身的理论缺 陷，结合公务员制度的现状，提出结论。 关键词：文官制度； 士大夫政治； 官僚制 民国时期文官制度的转型 Abstract The system of the civil service，refers the institution of recruitment 、appointment、 training and evaluation of the civil officials. It is the pivotal cornerstone of political system. The construction of civil service in ROC era is the first attempt to transition to modern civil service system. Research and probing the pros and cons of the issue would contribute to the construction of civil servant system nowadays. Due to the shortage of present research situation, this thesis will adopt the bureaucracy theory and the vertical comparative approach to in order to provide a new perspective to better understand the historical status and value of ROC era’s civil service system. The first chapter illustrates two basic concepts, the one is fundamental characteristics of traditional civil service system, i.e. scholar-bureaucracy, the other is basic mechanism of modern civil service system, i.e. bureaucracy defined by Marx Webber.
