摘 要 摘 要 农产品的质量就是农业发展的生命线，然而目前在我国林果业种植、生产以及收购 过程中存在的许多不利于市场竞争、损害果农利益和消费者合法权益的行为，这些行为 阻碍特色农林产业的可持续发展，并使得社会公共利益受到虽为隐形但严重的损害。本 文通过实地考察、数据分析和对比的方法，研究陕西省眉县猕猴桃产业发展的现状，发 现特色林果业在农产品收购中存在固定价格的法律问题，质量安全堪忧，质量的法律监 管不严，本地猕猴桃产业国际竞争力底下，严重损害农民短期和长远利益，不利于猕猴 桃产业的持续发展。综合分析以上问题成因，并借鉴国内外的经验，进而提出加强农产 品市场法制和农产品市场监管、以及充分发挥行业协会与农村合作社作用。综合解决特 色林果业持续发展中的法律问题，保护社会公共利益，必须规制特色农林产业生产经营 中的违法行为，使农民、经营者和消费者各方利益达到平衡。 关键字：猕猴桃、农林产业、产品质量、行业协会、可持续发展、消费者权益 I Abstract Abstract Agricultural product quality is the lifeline of agricultural development in China, but now the plant, production and horticulture existing in the acquisition process many unfavorable to the market competition and damage .To interests and the legal rights and interests of consumers, these actions impeding features the sustainable development of forestry industry, and make the social public interests are although be invisible but serious damage. Through on-the-spot investigation, data analysis and contrast method, the industry development of shaanxi province present situation of kiwifruit, this has found horticulture acquisition of agricultural products, the fixed price quality safety problems, and influence international competitiveness, serious damage, legal issues, such as short-term and long-term interests, farmers against kiwi industry sustainable development. This article comprehensively genesis, and analyze above problems at home and abroad, and then the experience from the aspect of law system and strengthening the agricultural market agricultural market supervision, and give full play to industry association and rural cooperatives effect
