土地空间分层利用中的不动产权利登记问题研究* 何乃刚** On the Real Estate Registration in Multi-level Land Development He Naigang 内容提要：本文以城市发展中日趋丰富而深入土地空间分层利用为背景，以《物权法》第136条规定为基点，着重探讨由此而生的不动产权利登记的有关问题。文章首先介绍了国内关于“土地空间权”的各类观点，认为土地空间权利作为一束权利，并不能独立于传统物权体系。文章总结了国内各层级法规及规范性文件的规定和实践做法，并借鉴美、日、德及台湾等国家和地区的法律规范以及海外学者的研究成果。针对我国土地空间利用所涉不动产权利登记中的问题，认为土地空间分层利用的不动产登记应当纳入现有不动产登记制度体系，应区分不同的开发利用形态和权利类型确定登记范围，并建议引入立体宗地和共有宗地概念，登记中应淡化公（共）用面积的分摊，逐步建立三维全覆盖的地籍管理体系。 关键词：不动产登记 土地空间分层利用 Abstract：Multi-level Land Development has been a tendency in urban exploitation. It is specified that the right to use construction land may be created separately on the surface of or above or under the land in Article 136 of Real Right Law of the People s Republic of China, but there are still some unresolved problems of real estate registration in multi-level Land Development. After the introduction of different viewpoints of airspace rights, the author critically views that the real rights in multi-level Land Development should be regulated by Real Right Law. The author gives an all-aspect outlook of rules，regulations practices of real estate registration in multi-level Land Development in China. The thorough research of real estate registration of superficies right of space in German laws, Japan laws, Taiwan district laws etc, constitutes an important part of the thesis. Many valuable suggestions are given in conclusion, such as, considering the real estate registration in multi-level Land Development as an inalienable part of the real estate registration system, introducing of the idea of stereo land parcel，desalinating the house property sharing area apportion, intensifying the 3D cadastral administration system. Key Words：Real Estate Registration Multi-level Land Development 一、概述 社会发展和科学进步，人口数量的膨胀和集聚，城市化程度不断提高，促使人类对土地的利用不断突破原有概念和范围的限制，围绕地表上下空间实施分层利用已经成为集约节约用地的重要内容和方式。土地立体利用的日趋频繁使得传统以地表为中心的所有权理论无法适应时代趋势，因为土地立体使用的结果，使得离开地表之地下或空中横切断层发生了使用价值，而这种断层的空间，既有了独立的经济使用价值，就必须赋予土地法的权利，即由传统上及于地表上下垂直纵向的土地所有权与利用的法理，转换为地表之上空或地下横切区分所有权与利用的法理。
