土地储备立法研究 何乃刚 内容摘要：十五年来，我国土地储备制度的运行与发展经历了起步、迅速发展到逐步规范调整的过程。地方性政府规范以及政策性文件、甚至包括政府会议纪要是推动土地储备迅速发展的关键支撑。由于缺乏国家层面统一的立法规范，各地土地储备的发展在运行模式、储备范围、程序规范、资金筹措方式等方面存在差异。同时，由于缺乏统一立法（上位法）的支撑，土地储备运作的合法性也备受争议，影响了其可持续发展。实践已经证明土地储备在推动土地使用制度改革中的积极作用。多年的实践探索和理论研究，为土地储备制度纳入国家层面相关立法规范奠定了坚实的基础。提升立法阶位，统一立法规范，将土地储备作为一项重要制度纳入土地管理立法，并在相关条例中做出具体规范，将是可行而有效的立法模式。 关 键 词：土地储备 立法 Abstract: The operation and development of Chinese land-banking system could be traced from the very beginning to a stage of frequent update, and further step into a status of being regulated in progress within the past fifteen years. The point to keep this system move on is the regulations and policies from the local government, even the meeting minutes from the authorities. Due to lacking of an uniform legislation in the state level, the divergences exist everywhere in the system of China, from the operation module, to the applicable scope, from the regulating procedure, to the financing resources etc. In addition, the legitimate of the system operation is also doubted by many people without the uniform legislation aforesaid, and further impacts its continuous improvement. Many cases already demonstrate the positive influence of the land-banking to the land system reform. Furthermore, practice and studies constitute the solid base to set up a legislative system for land-banking in the state level. Therefore, the proposal is given at the end as a feasible way to enhance the legislative hierarchy for the land banking, unify the relative regulations, and regulate the activities concerned as an inseparable part of land system in China. Key Word: Land-banking, Legislation 从1996年我国第一家土地储备机构上海市土地发展中心正式成立至今，土地储备制度经过十几年的发展，已经在全国遍地开花，土地储备主流工作的内容已基本稳定。但是，土地储备的法律定位以及相关问题一直备受争议，加强立法已成必然之势。 一、我国土地储备法律政策规范的现状分析 1、我国土地储备制度的发展历程 简单来说，可以把我国土地储备制度的发展过程分为三个阶段： 起步阶段（1996-2000）：1996年，我国第一家土地储备机构上海市土地发展中心正式成立。1997年，杭州、青岛等地相继建立土地储备制度，1999年国土资源部向全国推广杭州、青岛两市开展土地储备的经验。 大发展阶段（2001-2005）：2001年，国务院下发《关于加强国有土地资产管理的通知》(国务院15号文件)，明确要求“为增强政府对土地市场的调控能力，有条
