内容摘要 民事公诉制度是近年来民事诉讼理论研究的热点问题。但是理论界对于民事公 诉制度的理论基础以及民事公诉制度在我国建立的必要性和可行性并未形成一致 意见。而我国公共利益受侵害的现状要求理论界对公共利益的保护方式作出及时可 行的探索。鉴于此，笔者选择《论我国民事公诉制度的构建》作为毕业论文题目， 论文重点对民事公诉制度的理论基础及其在我国建立的必要性和可行性问题进行 了深入细致的研究。 欲对民事公诉制度进行研究，首先需要对民事公诉制度的基本理论有所了解。 因此，本文第一章即为：民事公诉制度的基本理论。本章首先对民事公诉制度的内 涵做出界定，进而对民事公诉制度的理论基础做出深入分析，在此基础上，从公正 和效率两个角度对民事公诉制度的价值进行剖析。 本文第二章运用比较研究方法对两大法系民事公诉制度进行考察。本章首先介 绍了法国、日本和俄罗斯等大陆法系国家的民事公诉制度立法，随后介绍了作为英 美法系代表性国家的英国和美国的民事公诉制度立法，最后对两大法系代表性国家 的民事公诉制度立法进行比较评析，对其中的差异和相同之处进行了归纳，从而为 我国民事公诉制度立法提供借鉴。 民事公诉制度本身的价值及其在他国的成功实践并不意味着其当然地适用于 我国。本文第三章论述了我国建立民事公诉制度的必要性和可行性。本章第一部分 从我国的现实需要方面论述了我国建立民事公诉制度的必要性。本章第二部分，从 我国的现实需要和我国有关民事公诉制度的立法历史和检察机关的性质定位等方 面论述了我国建立民事公诉制度的可行性。 制度的建设必须具有可操作性。本文第四章以检察机关为中心对民事公诉制度 涉及的具体程序问题进行构建。本章第一部分分析了有关检察机关在民事公诉中的 法律地位的几种代表性的观点，明确提出检察机关在民事公诉中的法律地位应当为 民事公诉人。本章第二部分对检察机关民事公诉的案件范围进行划定。本章第三部 分以检察机关为中心对民事公诉制度中的具体程序进行构建和设计，以使民事公诉 制度具有可操作性。  关键词：民事公诉  公共利益  公益诉讼 I Abstract The civil prosecution system is a little bit hot problem in the civil procedural theories studies in recent years.But the theories fields about the theoretical basis of civil prosecution system and the necessity and possibility of it in our country didnt become a consistent opinion. The present condition that public interests are violated badly requests that the theories fields explore feasible methods of public interests in time.Owing to this, the writer choosed “the establishiment of civil prosecution system in our country” as the graduation thesis.This thesis goes deep into the theoretical basis of civil prosecution system in our country and the necessity and feasibility of it. To do research to the civil prosecution system, it’s necessary to know about the basic theories of civil prosecution system at first.Therefore, the chapter 1 of this thesis is:The basic theories of civil prosecution system.This chapter definites the connotation of civil prosecution system at first, then does thorough analysis about the theoretical basis of civil prosecution system.On this foundation,the thesis carries on
