完善我国夫妻财产制的思考 摘要 夫妻财产制又称婚姻财产制，它是关于夫妻婚前财产和婚后所得财产的归属、管理、使用、收益、处分、债务的清偿以及婚姻解体时财产的清算等方面的法律制度。[1]某一国家采取何种夫妻财产制立法模式与类型既受自身立法传统。风俗习惯及思想文化的影响，又与社会发展。家庭结构变化，乃至夫妻各自经济独立紧密相连。2011年8月12日《婚姻法》的最新司法解释规定我国夫妻财产制是法定婚后所得共同财产制，个人特有财产制与约定财产制的结合。最新司法解释对婚前、婚后房产作了详细、具体的规定，曾在当时社会引起轩然大波。现实生活中，夫妻共有财产不仅会受到夫妻一方的侵害，也会受到夫妻双方之外的第三人的侵害。同样，第三人的合法利益也会受到一方或双方的侵害。因此，现代夫妻财产制以兼顾个人利益和社会利益为立法宗旨。 关键词 夫妻财产制度；法定财产制；约定财产制；夫妻共同财产 ABSTRACT Marital property system is also called matrimonial property regime.It is about the ownership and management of marital property.Marital property acquired after marriage,the use of proceeds of disposition of debt repayment and dissolution of marriage when the liquidation of property and other aspects of the legal system.A country takes matrimonial property regime and the legal system and the type of legislative model legislation affected their traditions,custom,ideas ,culture ,social development change in family structure and even the couple tied their economic independence. August 12,2011,the latest judicial interpretation of the marriage law ,The provisions of the statutory matrimonial property regime is the common property of the marriage system of income .Combined with the unique property system and agreed personal property system.The latest judicial interpretation of the property before and after marriage made detailed and specific provisions,It has caused uproar in the social.In real life ,matrimonial property will not only be against one of the spouses,will also be against a third person outside the couple.Similarly,the legitimate Interests of the third part will be against one or both spouses.So modern marital property to your personal interests and social interests into account for the purpose of legislation.
