内容提要 随着国际上对劳工权利的日益重视 国际劳工标准问题在经济全球化的大背 景下 也日益成为一个有争议的热点 同时也是发达国家和发展中国家在新一轮 多边贸易谈判中一个难以调解的分歧点 本文分别从三个层次介绍了国际劳工标 准的相关问题 并针对由贸易引发的劳工标准之争,表明了我国对是否应加入同 一的劳工标准的态度 及就国际劳工标准的核心或主要方面与我国劳动立法进行 比较 寻找它们的差距 从而为在多边贸易体制下 完善我国的劳动立法 提出 了几种具有针对性的建议 以期加强中国的劳动法制建设 使中国的劳动法制环 境与国际劳工标准接轨 从而为我国参与国际竞争创造良好的法制环境 以促进 经济发展 第一部分阐述了国际劳工标准相关问题 第二 三部分 谈了发达国 家及发展中国对是否应加入同一的劳工标准的不同立场 笔者对此的评价 及我 国对此持有的态度 第四部分则是从国际劳工标准的核心或基本标准与我国劳动 立法进行比较 寻找它们的差距,提出改革和完善我国劳动法制的建议 本文旨 在引起有关人士对贸易与劳工标准发展态势的关注 从而进一步加强我国劳动法 制的改革 主题词 国际劳工标准 贸易与劳工标准之争 劳动法制 完善 2 Abstract With attaching importance to the laborer ’s right increasingly in the international society, International Labor Standard has become a disputable hotspot in recent years at the background of economic globalization. That is to say, it has become an impenetrable branch point in trade negotiation between developing countries and developed countries. This article introduces something concerned International Labor Standard, and indicates China’s attitude to whether we should participate in the same labor standard according to the barrier between trade and labor standard. Then, on the grounds of the differences between the core labor standards and our labor legislation, finding their gaps. At last, the author puts forward several pointed suggestions to perfect our labor legislation. The purpose is to strengthen the construction of our labor legal system, and to bring our labor legal system more in line with international labor standard.
