论我国授权立法的宪法规制 中文摘要 中文提要 授权立法，是有关立法权授权的制度，它是现代社会立法内容专业化不断发 展的产物，是对传统宪政理论的一种挑战。而随着我国法治国家建设进程的推进， 授权立法这一在现实需要与合宪性质疑的夹缝中生存与发展的制度，终有一日要 面对民主与宪政的拷问。既然如此，不妨积极探索授权立法的生存之道，使授权 立法制度逐步向宪政的本质要求靠拢，以避免“立法权旁落”对立法正当性的冲 击。缘于此，本文从宪法学的视角对授权立法制度展开研究，对我国授权立法的 宪法规制问题进行了分析。文章首先界定了宪法学语境下授权立法的涵义，其次 论述了授权立法宪法规制的意义以及对授权立法进行宪法规制需要遵循的基本原 则，最后对我国授权立法宪法规制存在的问题进行了分析，并在此基础上提出了 对授权立法宪法规制进行完善的建议，以期在宪法框架之内觅到授权立法的发展 路径，为我国的法治建设和宪政建设尽绵薄之力。 关键词：授权立法 宪法规制 监督 作 者：刘晓冰 指导老师：陆永胜 I Abstract The Constitutional Regulation of Authorized Legislation in China The Constitutional Regulation of Authorized Legislation in China Abstract As the name implies, authorized legislation is the system about legislative authority. It ’s the product of changing modern society which challenge the theory of traditional constitutionalism. Although conforms to the practical needs, it against the principles of the Constitution which require democratic legislation. With the development of legal system in China, this problem should be solved. Therefore, I hope to explore the survival of authorized legislation and gradually make its system approach to the essential requirement of constitutionalism to avoid the questions about its democratic and legitimacy. Because of this, in this paper, I would analyze the authorized legislation system and its constitutional regulation problem in China from the constitutional stand-point . First of all, I would define the meaning of authorized legis
