论被监护人侵权责任的承担 中文摘要 论被监护人侵权责任的承担 中文摘要 被监护人致人损害的侵权责任承担问题是侵权法领域尚需深入研究的问题，它反 映了立法对监护人、被监护、受害人三方利益的衡量。本文从被监护人侵权责任承担 的理论基础说起，分析了监护人责任的性质、归责原则，以及被监护责任承担的依据、 模式；以《侵权责任法》第32 条为基础，系统分析了我国在被监护人侵权承担问题 上的相关学理问题，包括我国监护人的归责原则，《侵权责任法》第32 条第1 款与第 2 款的关系，以及被监护人致人损害的构成要件、承担规则；进而提出了我国在完善 被监护侵权责任问题上的五点建议，涵盖被监护人责任主体地位的规定、委托监护的 完善、公平责任的适用、监护人减轻责任的具体认定、父母离婚后的责任承担问题。 关键词：监护人 被监护人 侵权责任 承担 作 者：周秀人 指导老师：李中原 教授 I Abstract Assumed the Guardians Tort Liability Assumed the Guardians Tort Liability Abstract A study of the liability of the damages made by the person under guardianship needs further research in the field of tort law.
