我国渎职罪主体的方向分析研究.pdf

摘 要 渎职罪是国家机关工作人员利用职务上的便利，采取非法手段谋取经济利用，或者 滥用职权、玩忽职守，徇私舞弊，导致国家和人民的利用遭受重大损失的犯罪。由于职 务犯罪具有主体的特殊性、行为侵害社会关系的多重性及对职务的违背性等特征，所以 比一般的刑事犯罪表现出更广泛、更严重的社会危害性，加大对渎职罪的打击是刻不容 缓的。但是我国刑法对关于渎职罪的规定还有很多不成熟、不合理之处，反映到司法实 践中，刑法规定无法科学的指导渎职犯罪的司法实践，从而使渎职罪的惩处非常被动。 近年来，渎职犯罪又呈现愈演愈烈的趋势。因此，本文集中 渎职罪主体问题进行探讨 研究，在渎职罪主体基本理论的前提下，将研究的重点放在争议问题和疑难问题上，并 对渎职罪主体法律规定的不足提出完善的建议。概括起来，本文由三个部分组成。 第一部分是关于渎职罪主体的概述，主要介绍渎职罪主体的概念和本质特征。 第二部分从渎职罪立法的历史沿革着手，进而探讨国内外渎职罪主体的立法现状， 希望能够吸收国内外立法的经验，并结合我国国情，总结出我国渎职罪主体立法的发展 趋势。 第三部分提出我国关于渎职罪主体的立法和立法解释的不足，论述完善立法的必要 性并提出自己的立法建议。 关键词：渎职罪主体，本质特征，立法现状，立法建议 V ABSTRACT Of dereliction of duty are functionaries use their convenience, and use illegal means to seek economic use or abuse, neglect of duty, favoritism, causing great losses on the use of crimes of the State and the people.
