内 容 摘 要 农业是第一产业，是国民经济得以稳步发展的基础，农业的发展对其 他产业健康有序的发展起着至关重要的作用。农业保险做为农业发展的重 要保障措施，已经受到越来越多的国家的重视，各国纷纷开展农业保险实 践活动，其中很多国家都通过法律的形式来规范和完善农业保险的发展。 我国是农业大国，同时也是遭受自然灾害最为严重的国家之一，农业保险 对稳定我国农业的发展非常重要的。在这一过程中，最重要也是最有效的 方法就是促进农业保险业的发展。通过农业保险分散农业生产中的高风 险，保障农民、农业投资者的基本收益，稳定社会秩序，最终为我国经济 发展提供扎实的基础。然而，我国的农业保险的发展却经历了曲折的过程， 一直发展缓慢，究其原因，最主要得原因是我国到目前为止仍没有一部调 整农业保险的专门法律，这使农业保险的法律保障体系极其薄弱。要改变 这一状况，我国只能加快农业保险法制建设，使农业保险真正有法可依， 才能调动投保人的积极性，增强投保人的保险意识，才能促进农业的稳定 健康发展。 关键词：农业保险 农业保险法 立法构建 1 Abstract As the first industry, agriculture is the foundation to keep the national economy developing stably, it also plays an vital role in keeping other industries develop healthily and orderly. Agricultural insurance, as an important guarantee for the development of agriculture, has been practised by a growing number of countries ,most of the countries have enacted agriculture insurance law to regulate the form and improve the development of agricultural insurance. China is a big agricultural country, but also suffered from the most serious natural disasters ，Agricultural insurance is very important to stabilize the development of the culture ance.
