天津职业技术师范大学 Tianjin University of Technology and Education 毕 业 论 文 专 业： 人力资源管理 班级学号： 人力1102 - 20 学生姓名： 李兆岚 指导教师： 张旭军 讲师 二〇一五年六月 天津职业技术师范大学本科生毕业论文 新劳动合同法环境下的人力资源外包研究 The human resources outsourcing?of?the new labor contract law environment 专业班级：人力1102 学生姓名：李兆岚 指导教师：张旭军 讲师 学 院：经济与管理学院 年 6 月 摘 要 自2013年7月1日起开始实施的《劳动合同法修正案》就人力资源外包某些内容做出了相关规定，其中受关注最多的就是劳务派遣。与此前的《劳动合同法》相比，《修正案》在劳务派遣用工的行政许可、同工同酬、“临时性、辅助性和替代性”的界定以及违反劳务派遣的法律责任等方面重新进行了调整。作为正在起步阶段的人力资源外包国家，我国法律法规还不够完善，此行业从业人员对基本理论知识也不够熟悉，缺乏专业性。本文主要从人力资源外包的基本理论和外包模型入手，分析我国发展人力资源外包的内外部动因，并结合国情对《修正案》进行解读，从而得出我国人力资源外包行业的现状，以及存在的种种问题。由问题所产生的风险作为本文最重要的一点，剖析风险的来源并建立识别风险的步骤，最终总结出在企业发展不同阶段的风险控制对策，为降低法律风险提供保障。 关键词：人力资源外包；劳动合同法修正案；风险控制对策 ABSTRACT Since July 1, 2013 start of the Labor Contract Law Amendment on human resources outsourcing certain elements make the relevant provisions, which concern most is dispatched. As outsourcing is the initial stage of the human resources of the country, our laws and regulations is not perfect, this industry practitioners to be familiar with the basic theoretical knowledge is not enough, lack of professionalism. In this paper, the basic theory of human resources outsourcing and outsourced models, analyzes the internal and external development of human resources outsourcing motives, combined with national conditions amendments to interpret, to arrive at the status quo of human resources outsourcing industry, and the presence of problems. Risks arising from the issue as the most important point of this article, the source of risk analysis and the establishment of risk identification step, finally summed up in different stages of enterprise development, risk control measures, to reduce legal risk protection.
