论商品房预售制度的研究方案.doc

论商品房预售制度研究 （西南政法大学 经济法学院；重庆 401120） [摘要] 我国商品房预售制度始发于上个世纪五十年代，经香港发展传播入大陆，不断扩大规模，成为现今我国商品房买卖制度中不可或缺的一种交易方式。当前商品房预售的交易过程中存在诸多风险，反映了我国商品房预售制度中存在很多的不足，亟需一套完备的法律法规来对我国商品房预售进行管理和监督以维护市场交易的安全稳定。因此应对商品房交易过程中存在的问题，更需要从根本制度上找出问题所在并加以解决。首先针对我国现行商品房预售制度的特征及所呈现的现行加以阐述，再针对目前社会普遍存在的商品房交易所存在的问题进行更全面的分析，最后，针对如何完善我国商品房预售制度提出本人的观点和建议。 [关键词] 商品房预售；法律法规；制度完善； 一、我国商品房预售制度的概述 商品房预售，又称作期房买卖，其指预售房（房地产开发经营企业）我国[1]符启林.商品房预售法律制度研究[M].北京：中国政法大学出版社，2001.39-54. Meager opinion about housing presale system in China Economic Law School Jiang Nan Abstract：50 start presale system in China in the last century, development spreading into the Mainland via Hong Kong, ever-expanding, now an integral part of a mercenary system in China trade.Current House in advance sales of transactions there are risks, reflects the many deficiencies in the presale system in China, need a complete set of laws and regulations on the presale for the management and supervision to safeguard the security and stability of the market. One event in the House is concerned with peoples livelihood, solving the housing problem is not just the people resolve housing problems in the trading process, more needed from the underlying system identify the problems and solve them.Starting characteristics of the current presale system in China and the current to be elaborated, for commercial transactions of the prevailing social problems of a more comprehensive analysis and, finally, on how to improve my presale system in Chinas views and recommendations.
