一房二卖法律问题研究 摘要： 随着我国市场经济的发展，一房二卖现象也逐步成为人们关注的焦点问题，一房二卖是基于房屋出卖人的逐利性和违反民法诚实守信原则形成的， 其目的往往是为了获得更高的利润追求，这同时也就侵害了房屋买受人的利益，对一房二卖的研究，有助于我们解决现实问题，保护房屋买受人不受侵害，从而达到维护市场正常交易秩序的目的。一房二卖不仅涉及物权法的相关理论，包括物权变动、预告登记等。同时包括了债权的相关内容，例如债权人撤销权、违约中的损害赔偿请求权和惩罚性赔偿等。 本论文正是在这样的背景下尝试对中国的一房二卖现象进行分析，包括我国法律对一房二卖情形的救济措施等，目的是通过对其进行简要分析，为减少一房二卖情形提出可行性建议。 关键词：一房二卖 法律救济 立法建议 Study on the legal problems of a room two sell Abstract： With the development of our market economy, one of the housing two sell phenomenon has gradually become the focus of attention, one room two sell is based on the housing seller of the profit and the violation of the principles of honesty and trustworthiness of civil law form, its purpose is often to get higher pursuit of profit, this also is against the house the interests of the buyers, the research on a room two sell, can help us to solve the practical problem, the protection of housing buyers are not infringed, so as to protect the normal market transaction order.
