侦查人员出庭“作证”问题研究 【摘　要】 侦查人员出庭“作证”是指各种侦查主体在庭审过程中根据辩护方申请,经人民法院同意,或者人民法院依职权通知,当庭就侦查过程中调查、保全的证据的真实性与客观性以及证据收集、保全程序的合法性以言词方式向法庭作如实陈述,并接受辩护方质询或法官询问,以审查该证据的诉讼活动。侦查人员 国外主要指警察 出庭“作证”一般多存在于英美法系国家。根据中国目前的司法实践情况,全盘移植国外警察出庭“作证”程序的可能性不大,尚可采用一种变通过渡的方法。 【关键词】 侦查人员;出庭;作证 Study on Appearance before Court As A Witness by Investigators Abstract The appearance before court as a witness by investigators means that it is a procedure action of investigation and examine proof beyond a reasonable doubt for each kind of investigative subjects to make the stating of finding-facts in words before court about the trut
