论行政诉讼中的调解 摘要 在行政诉讼中，由于公共利益不可出让、公权力不可处分、司法权与行政权分工的不同、行政诉讼的主要任务以及行政法律关系双方不平等地位和调解制度本身具有一些弊端等原因， 我国现行《行政诉讼法》第 50 条明确规定：“人民法院审理行政案件，不适用调解”。确立了我国行政诉讼制度中原告与被告之间不得和解以及人民法院不居中调解的制度。 但在实践中，人们从未停止过对中国能否建立行政诉讼调解制度的探索，而且在现实行政官司中，调解手段用的也越来越多。近些年来，在构建社会主义和谐社会的大背景下，更激起了理论与实务界对行政调解制度探索的热情。各学者对于当代中国在行政诉讼中是否应该引进或者能否引进调解制度，也是众说纷纭、莫衷一是。但是，总体来说把调解纳入行政诉讼中是大势所趋，也有其根本意义所在。 关键词: 行政诉讼 调解 法律 原则 ABSTRACT In the area of administrative litigation, due to the public interest can not be sold、public power should not be punished、the different division labour of the judicial power and administrative power in administrative litigation、the main tasks of administrative litigation and the both sides of the administrative legal relationship is inequality and the mediation system itself has some drawbacks and other reasons, Chinas current administrative procedure law clearly stipulates in the fiftieth law: the peoples court hearing of administrative cases, mediation does not apply. This establish the system of administrative litigation in our country between the plaintiff and the defendant shall not reconciliation and the peoples court mediation system can not suit the mediation. But in practice, people have never stopped the exploration on whether China can establish the mediation system of administrative litigation or not , but also in reality administrative litigation, the use of mediation means become more and more. In recent years, under the background of the construction of socialist harmonious society, it aroused the exploration enthusiasm at the theory and practice of administrative mediation system. The scholars of contemporary China in the process of administrative litigation should be introduced or whether the introduction of mediation system is suitable have different opinions.
