JIANGXI AGRICULTURAL UNIVERSITY 课 程 论 文题目：略论网上银行电子支付法律问题研究学 院： 计算机与信息工程学院姓 名：学 号：专 业：年 级： 12指导教师： 职 称：指导老师二0 14 年 11 月 摘要 网上银行电子支付是近年来颇受法学界和商务实践领域所关注的热点问题。国内有学者曾断言，电子支付对传统的法学理论产生了巨大的冲击。确实，在电子化、数字化时代已经到来的今天，电子资金划拨日益成为我们日常生活中所普遍运用的资金支付与结算方式，因而如何运用法律来解决在电子支付中产生的矛盾与纠纷，特别是如何确定银行及客户应当承担何种法律责任的问题，就显得非常迫切而现实。而目前我国网上银行采用的规则多是协议方式，而无专门的法律法规，因此出现问题时多通过仲裁解决，尚欠缺明确的法律规定对包括在因特网上的电子支付进行调整。本论文将针对这一现象探讨网上银行电子支付有关的法律问题，论述网上银行电子支付的定义、特征、方式、以及对传统法律体系的挑战、法律风险、法律原则等基本问题，重点研究网上银行电子支付各方当事人的法律关系、承担责任的归责原则、间接损害赔偿问题及法律责任分担等问题，建议借鉴国外网上银行的发展经验及法律法规引导我国网上银行电子支付的发展，并从理论上提出建立健全我国网上银行电子支付法律制度的宏观思考，以及在实践中网上银行业务应采取的具体措施。旨在大力发展我国的网上银行业务，使其能在加入WTO组织后面临的国外网上银行的竞争中立于不败之地。 关键词：网上银行 电子支付 电子资金划拨 法律关系 法律责任AbstractOnline banking electronic payments is a hot issue in recent years, popular jurisprudence and business practice areas of concern. Domestic scholars have asserted that the electronic payment of traditional legal theory had a tremendous impact. Indeed, in electronic, digital age has arrived today, the electronic transfer of funds is becoming funds to pay for the settlement of our daily life in general use, and thus how to use the law to resolve conflicts and disputes arising in electronic payments, particularly how to determine which banks and customers should bear the liability issue, it is very urgent and realistic. At present, our rules are mostly used in online banking agreement, without the specific laws and regulations, and therefore there is a problem when more than settled by arbitration, still lacks a clear legal provisions for electronic payments, including on the Internet can be adjusted. This paper will explore the phenomenon of online banking electronic payment-related legal issues, discusses the basic problem definition online banking electronic payments, features, aspects, and the challenges to the traditional legal system, legal risk, legal principles, focusing on online banking electronic payment of the legal relationship of the parties, responsibility imputation
