湖北大学本科毕业论文 题 目 高校学生自治权的实现和保障——以摒弃特别权 力关系理论为视角 姓 名 郭杨 学 号 2011221110310034 专业年级 2012级法学双学位 指导教师 郑全新 职 称 教 授 2015年 4 月 15 日 高校学生自治权的实现和保障——以摒弃特别 权力关系理论为视角 摘 要 文章从高校与学生法律关系角度出发，指出了特别权利关系理论对我国高校法律制度的影响，在保障学生权利方面法律规定十分不明确，而且欠缺法律救济渠道。为此提出了构建学生自治权的的观点，首先介绍了学生自治权的主要内容，包括校务参与权、教育自由权、自我管理权和有限自治权。接着提出了保障和实现学生自治权的途径，包括完善法律制度、健全学生自治组织、保障学生组织经费、高校进行民主政治教育。学生自治权是高校法治化进程的必经途径，是民主法治的集中体现，我们必须为之付出辛勤的努力。 【关键词】特别权力关系理论 高校学生自治权 保障 实现途径  Autonomy of college students and its guarantee and ways —— to abandon the premise of the Special Power Relation Theory Abstract This article begins with the legal relationship between the University and students, points out the influence of special rights relations theory of the legal system of our universities, in the protection of students rights law is not clear, but the lack of legal relief channels. To do this proposes to build student autonomy viewpoint, first introduced the main contents of student autonomy, including the right to participate in school, liberty, education, self-management rights and limited autonomy. Then put forward a support and implement student autonomy means, including improving the legal system and improve student government organizations, student organizations guarantee funding for democratic and political education.
