析我国97刑法第13条的“但书”规定 摘 要 “但书”是指刑法中“情节显著轻微危害不大的，不认为是犯罪”的规定。尽管但书是我国刑法的一大特色，但是由于“但书”的规定与犯罪未遂和犯罪中止存在一定的冲突，加上其内容的不确定性，模糊了出入罪的界限，赋予了法官较大的自由裁量权，成为阻碍罪刑法定原则实现的最大的一个隐患。故此历来有部分学者对但书的存在价值有所置疑。笔者对这一问题进行了深入研究，认为“但书”具有实现刑法公正性和谦抑性的重大价值。能协调情与法，保证刑罚处理结果的实质公平合理，符合中庸的思维方式和我国的基本国情，刑法中应当保留这一规定。但是在适用中应严格把握但书的适用范围，注意克服其负面影响，从而更好的发挥但书的价值。 关键词 但书，内涵，渊源，价值，适用 ABSTRACT Proviso refers to the provision of the circumstance is not significant and the danger is minor, and do not think that is a crime of our country ’s Criminal Law . Though the proviso is a major feature of the criminal law, because that there is a certain degree of conflict between this provision and the attempted crime or the crime suspension. Besides, because of the uncertainty of its content, the boundaries of access to the crime are blurred .And giving judges more discretion certainly. So the proviso become the biggest hidden dangers to hindrance the principle of legality. Therefore, some scholars have always been questioning the value of the proviso. The author researched this issue intensively, considering that the proviso exists great value in realizing the criminal justice and restrictions on the scope of penalties. The proviso can coordinate intelligence and law, to ensure that the results of the penalty is really fair and reasonable. It is also in line with the moderate way of thinking and our basic national conditions. So this provision should be retained in the criminal law. However, in order to better play its value, the scope of its application in practice should be restricted strictly, more attention should be paid to overcome their negative impact.
