中文摘要 海运保函在提单运作中发挥积极作用的同时，其消极方面和所带来的一系列法律问题也不容忽视。本文通过分析海运保函的弊端，运用法律对其加以有效、适当、明确的规制，是解决海运保函问题的根本途径。研究海运保函，对于预防和避免海运欺诈，实现海事欺诈救济也具有着重大的现实意义和作用。但是我国海商立法对海运保函问题少有涉及甚至没有明文的规定，所以在司法实践中各地的做法并没有统一的标准。笔者通过借鉴海运保函相关制度在国外的经验，提出一些完善海运保函法律制度的建议。 关键词：海运保函；海事欺诈；法律规制 Abstract Shipping guarantee during the operation of the bill of lading play a positive role while its negative aspects and brings a series of legal issues also nots allow to ignore.
