“支付宝”网上第三方支付平台的法律问题 指导教师：XXX Abstract With the rapid development of network technology and the progress of the market economy, commodity trading online because of the huge amount of information goods, no time limit, trading and other advantages of gradually accepted by more and more consumers. Third party online payment platform not only makes the consumer online shopping more convenient for consumers to provide security. However, due to Chinas relevant legal system is not perfect, the lack of regulation of third party Internet payment in China, the legal nature and legal liability of the platform there is a big controversy. Because PayPal is our country third party online payment platform, the most influential representative of the enterprise, so this paper to Alipay as an example through the analysis of the legal nature and legal responsibility to pay treasure to reflect the third party payment platform has a series of problems. In this paper the case as the starting point through the case to find the problems. Through the case analysis of the legal nature of the payment of treasure, then pointed out that the current existence of precipitation funds, PayPal fraud and account security of these three problems, and through the three major issues to discuss pay treasure legal liability. Put forward some suggestions at the end of a series of legal problems to solve alipay.
