本科生毕业论文 论用人单位知情权 姓　　名 学　　号 专　　业 指导教师 2011年5月25日   摘 要 劳动纠纷来自劳动关系一方对另一方权益的侵犯与损害，有恶意侵权，也有出于对法律的无知侵权。实践中，劳动者在劳动关系中处于弱势地位，但近年来劳动者用利用伪造学历、制造虚假材料等手段欺骗用人单位与之签约谋取工作机会的做法在现实中屡见不鲜，使用人单位合法权益屡屡受损，这种行为违背合同法最基本原则——诚实信用原则，在劳动法中，属于侵犯用人单位知情权的违法行为。由于劳动者的这种行为构成对用人单位的欺诈，用人单位可向劳动争议仲裁委员会或人民法院申请认定该劳动合同无效。我国《劳动合同法》对合同订立过程中的劳动者知情权和用人单位知情权做了相应规定，并且规定了相应的责任承担方式。其目的是落实劳动合同签订过程中的诚实信用原则，保护双方当事人的合法权益。我国相关法律规定比较重视劳动者权益保护，而疏于用人单位的权益保护方面的规定。本文选择用人单位知情权问题进行研究，以期用人单位在履行告知义务的同时，也要充分行使自己的知情权，保护自己的合法权益。 关键词：劳动合同法；劳动者知情权；用人单位知情权；诚实信用原则 Abstract Labor disputes, labor relations from the interests of one party against another infringement and damage, malicious infringement, but also out of ignorance of the law infringement. ?In practice, workers in the labor relations in a weak position, but in recent years with the use of forged academic qualifications of workers, making a false material means to deceive the employer with whom the practice of contracting opportunities to seek work in the real common, the lawful rights and interests of people frequently use Damage, such acts violate the most basic principles of contract law - the principle of good faith, in the labor law, is an infringement of the employers right to know the offense.As workers of the employer which constitutes fraud, the employer may apply to the labor dispute arbitration committee or the peoples court finds that the labor contract.?Chinas Labor Contract Law in the process of contract workers and employers the right to know to do right to know the corresponding requirements, and provides corresponding methods of accountability.The aim is to implement the labor contract during the principle of good faith to protect the legitimate rights and interests of the parties.
