Through carrying on the comparison research on the legal husbands and wives property system in the intersectional area of China, we can find that there are many differences in the type、the structure、the legislation guiding thought and the specif- ic stipulation of the legal husbands and wives property system in the intersectional area of China, but at the same time each place legal husbands and wives property system also has certainly similarity. In future, four places of mainland and coast, taking these things in common as the foundations, should take effective measures to solve the conflicts of the legal husbands and wives property system in the intersectional area of China. Key words:Legal husbands and wives property system; Comparison research; Intersectional area law conflict 一、中国区际法定夫妻财产制的现实状况 夫妻财产制是调整夫妻财产关系的法律制度,是婚姻家 庭法律制度的重要组成部分。夫妻财产制与人们的家庭生活 休戚相关,而家庭的稳定又关系到整个社会的安定团结,在 一个国家里,夫妻财产制是否统一,对于该国经济的发展和 社会的进步是至关重要的。然而,由于历史的原因,中国两 岸四地长期处于分立状态,各自形成了独立的法律体系,在 婚姻家庭法律领域,存在着不同的夫妻财产制。其中,两岸 四地的法定夫妻财产制间的差异尤为突出,在“一国两制” 下还将长期存在。 中国大陆地区,夫妻财产制经历了夫妻一体主义时期、 清末民初国民党政府夫
