NATIONAL STEEL AND SHIPBUILDING COMPANY MILITARY SHIPBUILDING AND REPAIR PROGRAMS PURCHASE ORDER GENERAL TERMS AND CONDITIONS NASSCO FORM TC-MIL-GENRev. H September 13, 2012 1. Definitions The following terms shall have the meanings set forth below throughout this Contract: “ABS” means the American Bureau of Shipping. “Buyer” means National Steel and Shipbuilding Company, aka General Dynamics NASSCO or NASSCO. “Contract” means the Purchase Order between Buyer and Seller, including these General Terms and Conditions, the Special Terms and Conditions, the Specifications, and any other documents incorporated by reference. From time to time, the Purchase Order may be replaced by an agreement for either particular services or goods. This agreement may be in the form of a letter. If this circumstance is present, then the “Contract” shall consist of the Purchase Order, the agreement (whether in the form of a formal contract or letter contract), all of these General Terms and Conditions, the Special Terms and Conditions, the Specifications, and any other documents incorporated by reference by NASSCO. “Contract Price” means the total amount to be paid by Buyer to Seller in consideration of Seller’s full performance of this Contract, as set forth on the face of the Purchase Order. “Contract Problem” means a fact or circumstance of which the Seller is aware that does, will or reasonably is anticipated to (1) have a significant or substantial impact on the delivery schedule or completion of the Contract or the cost of the Contract (increase or decrease) or (2)?requires modification to the Contract or Specification(s). The terms “significant” and “substantial” shall be interpreted in the same manner as they would be interpreted by a reasonably prudent business person under the relevant circumstances. “Contract Products” means the products, material, apparatus, equipment, supplies, articles, data or other goods to be furnished by Seller under thi
