HGST Trademark and Logo Usage Guidelines for Authorized Third Parties Trademarks, logos and slogans owned by HGST Netherlands, B.V. (“HGST”) are valuable assets to HGST and its brand and act to distinguish HGST’s products from its competitors’ products. HGST takes many steps to protect against unauthorized or improper use of its trademarks, logos and brand. Third parties that are authorized by HGST to use its trademarks, logos and slogans are required to use them in a proper and consistent manner and in accordance with these Guidelines and the terms and conditions of any agreement you have with HGST or its affiliate companies. Although HGST allows authorized third parties to use HGST’s logos and trademarks if they follow these Guidelines, HGST retains all ownership rights in its logos, trademarks and brand. Any goodwill or legal rights created from use of HGST’s logos, trademarks and brand are for the benefit of and inure exclusively to HGST and not any third party. HGST has the complete discretion to revoke any right to use HGST’s logos, trademarks and slogans, even if such use is not expressly prohibited by these Guidelines. HGST may modify these Guidelines without notice to you. It is your responsibility to ensure that you are referring to the current version of these Guidelines. The following are authorized to use HGST’s logos and trademarks and must abide by these Guidelines: 1. Original equipment manufacturers (“OEMs”) that purchase internal hard disk drives, solid state drives, and platform products from HGST for integration into non-HGST products; 2. Authorized distributors that purchase HGST products directly from HGST for distribution only in regions authorized by HGST or its affiliates (“Authorized Distributors”); 3. Members of any HGST partner program (“HGST Partner Members”) that purchase HGST products directly from Authorized Distributors; and 4. Other third parties authorize
