PAGE  内 容 摘 要 公示公信原则正是符合物权变动的要求，而为大多数国家所接受，成为物权法的基本原则之一。认识并理解该原则基本原理，讨论如何建立一套完善的物权公示公信制度，是本文要解决的问题。本文分五个部分。 第一部分阐释了公示公信原则的基本原理，分别分析了两个原则的定义、历史发展、立法理由、功能，并详细研究了公信原则的适用问题，指出对不动产的公信原则各国有不同的态度，并分析产生这种分歧的原因。 第二部分讨论的是物权变动的公示方法。 第三部分讨论了物权公示的效力。 第四部分主要论述了公示的公信力，包括登记的公信力和占有的公信力。 第五部分探讨了我国物权法公示公信原则实施的现状与完善。结合我国新颁布的《物权法》,提出在公示要件主义的立法模式下，统一登记机关、采登记的实质审查主义，规定动产??意取得制度和不动产登记的公信力，进一步完善我国物权法的公示公信原则。 关键词：公示原则 公信原则 登记 交付 公示的效力 Abstract The principle of publication and indication meets the requirement of the real right alternation, so it has been accepted by many countries and becomes one of the basic principles of the law of property. Since the demonstrative principle plays an important role in the law of property, how to understand its fundamental theory and set up a scientific and reasonable system of publication and indication will be solved in the essay. There are five parts in the essay. Part 1 mainly studies the fundamental theory about the principle of publication and indication. I separately discuss the conception, development, legislation cause and the function of the two principles, then put the stress on the applying of the indication principle, point out different attitude toward the indication principle on real property, and analyze the reason. Part 2 elaborate the methods of the publication of alteration of property. Part 3 discuss the validity of property publication. Part 4 mainly researches the indication validity of property publication, including the indication validity of registration and the possession. Part 5 mainly explores how to perfect the principle of publication and indication according to the law of property of our country, the essay suggest that in creation mode of publication, we should integrate the office of the registration, carry out essence examination of application for registration and entitle the registration with the indication validity.
