中文摘要 家务劳动一直以来都是家庭生活的主要内容，2001年修改的婚姻法中新增设了关于家务劳动补偿请求的相关制度——我国现行《婚姻法》第四十条规定：“夫妻书面约定婚姻关系存续期间所得财产归各自所有，一方因抚育子女、照料老人、协助另一方工作等付出较多义务的，离婚时有权向另一方请求补偿，另一方应当予以补偿。”这项制度的设立从法律的一定程度上肯定了家务劳动的社会地位以及经济价值，这项制度同时也保护了对家庭做出贡献较多一方的合法权益，具有十分重要的意义。但是这项制度也存在不少的缺陷，由于是一项新增设的内容，实质上带有一定的实验性，其理论设计还有待完善，实际的可操作性更是有待加强，从立法至今，虽对家务劳动的保护起到了一定的作用，但其实现的效果跟预期相比并不令人怎么满意。因此，加强对家务劳动价值的讨论与保护，完善家务劳动价值保护的途径——补偿请求制度的立法设计，让其更有操作性，更好的实现其立法与执法目的，正是本文所追求的目标。本文将从家务劳动等相关基本概念的界定入手，探讨家务劳动价值保护的背景以及家务劳动价值保护问题研究的必要性及重要性，层层深入，进而讨论现行家务劳动价值保护的制度——补偿请求制度的实行情况。最后将针对实际的情况从笔者个人的角度提出对其制度立法的相关思考与建议。 关键词：婚姻法、家务劳动、价值、补偿请求制度、意义、分析、完善 Abstract Housework has always been a main part of family life. The Marriage Law amended in 2001 has newly added regulations about housework— The 40th item of the current “Marriage Law” of our nation stipulate as follows: As is agreed in written form, during the validity of marriage, belongings of the couple should be kept to themselves respectively. If one of the couple has devoted herself (himself) more to caring for children,the elderly and assisting the counterpart, she (he) deserves to ask for compensation from the the counterpart. The regulation above has legally affirmed the social status and economic value of housework. Meanwhile, the very regulation has upheld the legitimate rights of the more-devoted one of the couple ,which is of great significance. Nevertheless, there are quite a few deficiencies about the regulation above. Being newly added ,the regulation is somewhat experimental in essence. The theory of the item is yet to be improved, moreover, the practical application of it requires to be strengthened more. Ever since the establishment of the law, while the efforts to uphold the value of housework has taken effect somehow, but it has turn out to be far from satisfaction.
