Abstract Legal aid is a judicial relief system that is generally adopted in many countries.As a protection for citizens’ fundamental right, legal aid occupies a very important position in judicial system. In a sense,the perfection of legal aid reflects the perfection of one countrys rule of law. At present, my main contradiction of legal aid is the huge gap between aid resources and assistance needs.The cause relies on lacking a good mechanism which could absorb and use adequate social resources. National experience has shown that legal aid can not depend on government alone,the most effective way is using virous social resuoces and promoting a wide community involvement.So, this paper see legal aid as a social policy and borrow the paradigm of triangle welfare from its research,discuss the role of government、maket 、NGO in legal aid from law 、 economics 、sociology angles. In order to realize justice and harmonious benefit,we shoud construct the triangle welfare and also make them interact benignly. Except for inntroduction and conclusion, this paper is divided into three parts which has more than 30000 words. The first part is “The Basic Theroy about Legal Aid” Through introduction of the definition on legal aid at home and abroad,this part makes its own definition on legal aid, expandeding the definition in the existing law.And then,this part briefly introduced the history of legal aid.It points out legal aid originate from 15 century’s Britain,which experienced three stages as a civil act of charity、a act of state rights and a benefits of social behaviour. Finally, meeting the title,this paper analyze the relationship beteewn legal aid and justice as well as benefits harmony.It points out
