浅论代位析产制度 第三部分为研究结论。该部分结合上述理论分析解决本案中的争议焦点。第 一，在本案中，原告基于《查封、执行、扣押规定》对被告享有代位析产的权利， 有权提起代位析产诉讼。第二，本案中被告之间对涉讼房屋享有的权利性质属共 同共有。虽然在本本案中，被告之间并不存在共同共有赖以存在的共有关系的前 提，但是，根据我国《物权法》第103 条关于对共有性质推定的规定可知，共有 人之间没有共有关系，他们对共有财产约定为共同共有的，同样被法律所认可的。 第三，本案中的被告之间对共有财产的约定物权约定未经登记并不发生物权变动 的效力，就算当事人之间有相关物权变动的协议，该协议也只能在当事人之间发 生合同的法律效果，更谈不上对抗第三人之说。第四，对本案的处理意见，笔者 结合对上述问题的探讨分析,就本案的处理上提出自己的看法。 关键词：代位析产 共有关系 诉讼地位 无独立请求权的第三人 Abstraet Subrogation analysis production system is another system, maintain the lawful rights and interests of creditors with the subrogation system execution can be resolve in the judicial practice of difficult to execute two effective path, they are from a different Angle to safeguard the legitimate rights and interests of the creditors.
