工程量清单模式下承包商的索赔 摘要：工程量清单计价方式有利于企业结合自身管理水平、市场情况及工程实际自主报价，提高企业在建筑业的竞争力，在实施过程中也出现不少的新问题。清单计价规范的实施使承包人风险相对减少，如果承包人在工程实施各个阶段不注意专业与法律法规的结合，不注意有理有据的主张权利，自己的合法权益仍然得不到保障。本文以清单计价为主体，研究该模式下承包商的风险识别与分析及应对策略，以期为维护承包商的合法权益提供理论依据。二零零三年《工程量清单计价规范》的颁布标志着中国工程造价进入工程量清单计价阶段，经过 二零零八年工程量清单的重新修订，工程量清单计价模式已逐渐成熟并成为主要的计价模式。但索赔作为工程量清单计价规范中的重要组成部分，在清单规范中仅规定其索赔程序，而对索赔费用构成的内涵外延未曾界定，因此引起费用索赔是否包含规费、税金的争议。因此，在借鉴国际工程费用索赔的基础上，结合中国工程量清单计价的特点，提出国内工程费用索赔的体系框架是富有意义且亟待解决的问题。 关键词：工程量清单 索赔 索赔值 Contractors?claim under?engineering quantity list mode Abstract:?the engineering quantity list pricing?is conducive to enterprise?with its own?management level,?the market situation?and practical?self quotation,enhance the competitiveness of enterprises?in the construction industry,?the emergence of?many new questions?in the implementation process is also.?The implementation of?code of valuation with bill quantity of?the contractor?relativerisk reduction,?if the combination of?the contractor?at all stages of project implementation?does not pay attention to?professional?and legal?regulations,do not pay attention to?reasonable?rights advocate,?their?legitimate rights and interests?are still not protected.?This paper?takes the?list valuation?as the main body,?the?mode?of?the Contractors?risk identification and risk analysis?and coping strategies,?so as to provide theoretical basis for?the maintenance of?the legitimate rights and interests of?the contractor.?2003?standard?of valuation based on engineering quantity list?marks the promulgation of?Chineseengineering cost?into the?engineering quantity list valuation?stage,?after arevised?2008?engineering?quantity list?valuation mode of bill of quantities,?has gradually become mature and?become?the main valuation mode.?But the?claim as the?engineering quantity list valuation?component?specification,?in thespecification?only provides?the?list of?claims procedures,?and?composition?of claim expenses?not?defining the?connotation and denotation,?thus causing theexpenses claim?wh
