中国自由贸易试验区改革定位及建设政策探究 　　摘 要： 随着近日第三批自由贸易试验区的挂牌，我国自由贸易试验区建设进入了新的阶段。自由贸易试验区建设的核心是通过制度创新，助推全面深化改革、提升政府治理能力和对接国际经贸新规则。上海、广东、天津和福建作为自由贸易试验区的先行试点，在实践中积累了可复制可推广的经验，但也存着政府管制未能有效松绑、对非试验区的“虹吸效应”和相关法规的跟进等问题。下一步的自由贸易试验区建设应该注意处理好政府推动与市场决定的关系、试验区与非试验区的协同并进、“改革创新”与“于法有据”的关系，简政放权与事中事后监管等问题 关键词： 自由贸易试验区； 全面深化改革； 制度创新； 简政放权 中图分类号： F72 文献标识码： A DOI：10.13411/j.cnki.sxsx.2017.02.005 Abstract： With the listing of the third batch of the Pilot Free Trade Zone recently， the construction of Chinas Pilot Free Trade Zone has entered a new stage. The core of the construction of the pilot free trade area ，through the system innovation， is boosting the comprehensive deepening of reform， enhancing the governments governance capacity and docking international economic and trade new rules. As the first pilot of Pilot Free Trade Zone， Shanghai， Guangdong， Tianjin and Fujian have accumulated the experience， which can be replicated and be promoted in practice， but also exist problems such as government regulation failed to loosen， and there is no the relevant regulations to the “siphon effect” of the non-pilot zone. Therefore， the next step in the construction of Pilot Free Trade Zone should pay attention to the relationship between the government promotion and the market decision， the cooperation between the pilot zone and the non-pilot zone， the relationship between “reform and innovation” and “legal evidence”， administrative simplification and so on. Key words： pilot free trade zone； comprehensively deepening reform； institutional innovation； administrative simplification 自由?Q易试验区建设是新时期我国改革开放的实践探索，受到各方的高度关注。随着2017年4月1日，辽宁、浙江、河南、湖北、重庆、四川和陕西7个自由贸易试验区的挂牌，我国的自由贸易试验区数量增加到11家。自由贸易试验区肩负着在新时期加快政府职能转变、积极探索管理模式创新、促进贸易和投资便利化，为全面深化改革和扩大开放探索新途径、积累新经验的重要使命[1]， 是我国在新的历史时期以开放倒逼改革、以改革促进发展的探索性实践 一、自由贸易试验区是制度创新的“试验田” 制度创新是我国建设自由贸易试验区的核心内涵。自由贸易试验区是以“负面清单”管理模式为突破口，推进投资管理制度创新、金融制度创新、贸易监管制度创新和综合监管制度创新，进而促进政府职能转变，破除现有体制机制障碍，构建新的制度框架，形成以制度创新拓展开放层次，提升投资贸易便利化水平，促进经济结构调整升级的重大战略部署 自由贸易试验区用制度创新取代政策优惠，体现出了“行政收
