法治社会，正义不必过度解读 李纪兵 （中南大学法学院，湖南 长沙 410083） 摘 要： 正因为没有人会怀疑正义与良法的极端重要性，所以才产生了众人对正义与良法的过度解读，出现了“正义为先与良法为治”悖论。本文以亚里士多德名言为切入口，展示正义被过度解读有害无利的事实，并提出“法治社会大致可以用‘解放自由为先、明法诚信居中、自然正义殿后（加倍惩罚慑恶）’三原则恰如其分地解读‘良法、正法、恶法’，化解亚里士多德‘正义为先与良法为治’困境”的设想，将人真正从律法的捆绑中解放出来，同时也消除人们长期以来积累的对正义的不可数计的过度解读，破解正义女神蒙眼布的奥秘，还正义以本来面目。 关键词：正义； 良法； 报应； 解放； 自由； 法治 Justice Should not be Overreaded in Society being Ruled by Law Li-Jibing Deng-Lianfan Abstract: Because nobody will doubt the extreme importance of justice and good law, so everybody has a too much reading about them, and the paradox of justice and good law appears. Taking Aristotle famous as the entry point, this dissertation demonstrated the harm facts of justice is over-interpretated, and that the three rules of liberate and free first, clear and itergrity secondt, nature and justice (double punishment deter evil ) rear can appropriately interpret the principles of good laws, justice law, bad law, resolve Aristotles dilemma of “justice and good law ”, liberate people from binding of law truly, and eliminate the uncountable dollars for over interpretation of just which people have accumulated for years, crack the mysteries of blindfolded cloth of justice goddess,bring justice to its original feature as well.
