Abstract: The 4th Patent Law revision introduces in, for the fi rst time, the patent license of right system. Patent can enter into circulation with more ease under such a system. With emerging new problems, such as blocked supply-need channel, immature patent market, and the need to balance the interests between innovators and patent commercialization, patent development should not be confi ned to the original framework. The patent license of right system provides an ideal functional carrier for extending the patent system to market. Therefore, the construction of the patent license of right system should stress the opportunities, in a broad sense, that it can bring forth. The paper suggests starting from the patent license of right system, involving it into the patent industry layout, and build up a digital patent network platform.
