Chapter Four Offers A proposal for concluding a contract addressed to one or more specific persons constitutes an offer if it is sufficiently definite and indicates the intention of the offeror to be bound in case of acceptance .A proposal is sufficiently definite if it indicates the goods and expressly or implicitly fixes or makes provisions for determining the quantity and the price .Such a proposal is usually referred to as a firm offer in China’s foreign trade practice .Conversely, if a proposal for concluding a contract is made with reserve and contains such qualifying phrases as “ subject to prior sale” or “subject to our final confirmation” or “without engagement” , then the proposal does not constitute a firm offer . It is called free offer in China . An offer can be made by either the buyer or the seller .In making an offer the seller uses words such as “offer” , “quote” and “supply” while the buyer uses “book” , “order” or “bid” . When writing a letter for making an offer the offeror should 1 express thanks for the enquiry ; 2 provide details about price, discount and terms of payment; 3 state date of delivery or time of shipment ; 4 express hope that the offer will be accepted and assure the offeree of good service .
