交通事故中“撞伤不如撞死”问题浅析-高嵩.pdf

摘要 近年来随着经济的快速发展， 车辆的占有率和使用率日渐上升， 随之而来的交通 事故发生频率也随之升高。 而现今的法律、 法规对交通事故中的责任认定和赔偿数额 等方面的规定相对于实践中不断涌现出的新的问题来说， 显得有些力不从心。 由于法 律给民众的价值导向错误造成了实践中的撞伤不如撞死情况的发生。 这种情况的发生 显然有悖于构建和谐社会的理念。 因此有必要对于现行的法律、 法规对于交通事故的 责任认定和赔偿等规定所存在的问题进行深入的分析，并提出完善的方案。 全文共分为四个部分， 第一部分首先提出了撞伤不如撞死问题在实践中发生的案 例，第二部分就该案件发生的从理论上进行了分析， 第三部分从立法和司法两个层面 提出了对于现行法律的完善意见，第四部分对于全文进行了总结。 关键词 ：交通事故；二次碾压；责任认定；赔偿 I Abstract With the rapid economic development in recent years, growing share and usage of vehicles, with the incidence of traffic accidents has increased. Current laws and regulations on traffic accident of responsibility and compensation in the amount of provisions relative to the emergence of new problems in the practice, seem a bit weak. Value-oriented error of law to the people because of a hurt in practice than killed from happening. This is clearly contrary to ideas of building a harmonious society. There is a need for the existing laws and regulations for traffic accident responsibility and compensation provisions of the in-depth analysis of existing problems, and to submit a comprehensive plan. The full text is divided into four parts, part I first raised the issue of injuries than killed casesthat occur in practice, part II in respectof the casesanalysed in theory, part three from the legislative and judicial levels proposed for the present perfect views of the law, part IV summarizes the full text.
