侦查阶段犯罪嫌疑人申诉、控告权利保障研究 摘 要 申诉、控告权利是法律赋予犯罪嫌疑人的权利，但是1996年制定的刑诉法中刑事申诉、控告权也存在明显缺陷。而在我国刑事诉讼实践中，犯罪嫌疑人权利保护不足是大多数人所达成的共识。新的刑诉法已经出台，但是对犯罪嫌疑人权利保护仍有不足。实际上，我国立法上虽然明确了犯罪嫌疑人地位和权利，但由于缺乏相应的立法与司法双重层面上的权利保护与制度保障，犯罪嫌疑人的申诉、控告权利事实上无法得到真正的实现。因此，笔者从我国侦查阶段赋予犯罪嫌疑人的申诉、控告权利的原因出发，分析了我国侦查阶段犯罪嫌疑人的申诉、控告权的立法现状以及现阶段立法和实践中存在的问题，并提出我国侦查权阶段犯罪嫌疑人的申诉、控告权保障的完善措施。 关键词：侦查阶段；犯罪嫌疑人；申诉、控告权；保障研究 The Detection Stage Suspect Study On Protecting The Rrights of Appeal and Accuse Abstract The Rights of Appeal and Accuse all under the law the rights of criminal suspects,but the Criminal Procedure Law,enacted in 1996,the rights of appeal and accuse,there are obvious defects.In our criminal litigation practice,inadequate protection of the rights of criminal suspects is the consensusc reached by most people.The new Criminal Procedure Law has been introduced,but is still inadequate to the protection of the rights of criminal suspects.In fact,Chinas legislation clarified the status and rights of criminal suspects,but due to lack of legislative and judicial levels of rights protection system to protect the suspects the rights of appeal and accuse to a matter of fact can not be real implementation.therefore,from our investigation stage,the author given the complaints of criminal suspects charged with the rights of reason,analyzes the complaints of the investigation stage of ceiminal suspects, suspects,accused the right to legislative status and the problems at this stage of legislation and and raised in China stage of the investigation right of criminal appeal and accuse,charges of measures to improve security of tenure.
