边沁的功利主义刑罚观探析（Analysis of Benthams utilitarianism penalty view） Analysis of Benthams utilitarianism penalty view Author: Wang Wei Jeremy Bentham (Jeremy Bentham, 1748 - 1832), British philosopher, economist, utilitarianism and legal thinkers, devoted his life to the cause of the British legal reform, legal reform is the pioneer and leader of the movement in the United kingdom. Benthams times, from the British legal history, are the era of fierce struggle between the conservative forces and the revolutionary forces. In order to refute the famous British jurist Blackstone in Commentaries in the status of the British legal system for defense, promote legal reform, Bentham summed up in succession based on the idea, the first comprehensive exposition of the theory of utilitarianism, laid the theoretical foundation and the classical natural law philosophy from Britains legal system reform work. His ideas about legislative principles and legislative techniques contributed greatly to the English legal reform movement in the nineteenth Century, and to some European countries. Based on the value judgment of utilitarian principle, he paid special attention to criminal law and began to comment on the rationality of punishment as the beginning of his writing activities on the reform of law. Therefore, Benthams utilitarian view of punishment occupies an important position in his ideological system and has a deep influence in the modern criminal law circle. In the modern criminal thought of the bourgeoisie, the theory of deterrence, the theory of normative reinforcement, the theory of educational reform and the theory of satisfying revenge are closely related to this theory.
