集体土地所有权制度研究 摘 要 集体土地所有权制度是物权立法中的一个难点，由于涉及敏感的政治问题，该研究 并没有太大的突破。本文运用历史的考察方法和法社会学的方法，从该制度的发展历史 着手，详细地介绍了我国解放区的土地改革制度、农民土地所有制时期、集体土地所有 制时期、公有农用的集体土地所有权时期。回顾我国土地所有权的历史变迁，可以得出 一条历史规律：从古至今，我国集体土地所有权变迁，实质是在土地国家所有的基础上 不断强化完善所有权和使用权的分离，国家所有权在变迁中居于主导地位。 其次，分析集体土地所有权制度的立法现状及其缺陷。结合我国现行的法律法规， 分析我国集体土地所有权的立法缺陷，1.我国集体土地所有权主体虚位。主体虚位最终 导致经营管理者成为实际上的主体。现行法律未对经营管理者的权限予以规范和限制， 导致农民的土地权益收到侵害。2.权利性质模糊。介绍了国内学者关于集体土地所有权 性质的观点，笔者比较赞成新型总有说，即集体土地所有权是一种新型的总有，是由集 体成员即农民共同享有所有权的形态。既不同于个人所有基础上的共有，也不同于股份 制基础上的法人所有。3.权能残缺。包括使用、收益、处分权能不全。 再次，在评析集体土地所有权改革模式基础上，提出了笔者的观点，即实行集体土 地所有权的改良再造方案，以切实调动农民的生产积极性，实现土地资源的保护和有效 利用，保持农业和农村经济的持续、稳定、协调发展。 最后，在如果完善集体土地所有权的问题上，确定农村土地归农民集体成员共同所 有，改变“三级所有”的所有权模式，集体土地所有权主体“农民集体”统一为“村农 民集体”。“村民大会”是农民集体行使所有权的权力机构，但其不是常设机构，应设立 集体土地管理委员会作为集体土地所有权的行使主体。 关键词：集体土地所有权 农民集体 公有制 私有化 I 万方数据 II 万方数据 Study of collective land ownership system ABSTRACT Collective land ownership system is a difficult civil law, as it involves sensitive political issues, the study did not break too much.
