电子商务合同的相关法律问题研究 摘要：电子商务合同是电子商务中普遍使用的合同形式，与传统的合同制度比较，电子商务合同有许多不同的特点。本文着重对电子商务合同中要约的撤销与撤回问题，电子代理人问题，条款问题以及合同成立的时间地点问题等方面做了了深入的分析和探讨，这些问题对于发展电子商务、提高网上交易的成功率以及正确解决电子商务中的交易纠纷都具有十分重要的意义。对于电子商务合同而言，由于其是借助于国际互联网来传送和接收信息的，使之在要约与承诺问题，合同的条款问题，合同成立的时间和地点问题等许多方面与传统意义上的合同有着很大的区别，因此需要对这些问题加以深入的研究，并建立相应的法律体系进行规范。加强相关技术的研究、规则制定和适时的进行立法调整，不仅是对我国合同制度的完善，而且有助于发展电子商务，提高交易效率，降低交易成本，适应新经济时代发展的要求。 Abstract: E-commerce contract is the widespread use of e-commerce in the form of contracts, the contract system and traditional comparison, e-commerce contracts has many different characteristics.
